Escape Rentals USA Rental Terms for travel between 05-Jan-2018 and 31-Dec-2019

Important Information About Your Rentals
On arrival, you will be required to sign a rental agreement with the operators of Escape Rentals USA. Here is a summary of their terms and conditions:

Definitions
The following definitions apply for the Terms and Conditions for Escape Rentals USA.

    * The Supplier means the operator of Escape Rentals USA
    * The Client is also referred to as the hirer (s) or renter (s)

Payments
A non-refundable deposit will be taken from your nominated credit card at the time of booking confirmation. This percentage of the total fees will vary depending on the number of days your booking is placed before travel commencement.

The balance payment due will be collected upon pick up of the vehicle.

Note on foreign currency bookings: full balance of payment (including the deposit) will be collected at the time of confirmation if you have elected to process your booking in a currency different to US$. Please be aware that we do not accept Cash payments in New York. All Payments must be made with Credit or Debit card.

Some charges may be payable directly to your rental station upon arrival, these will be itemised as such in your breakdown of pricing if and where applicable.

Payment must be made in U.S. Dollars in cash or by credit card; MasterCard or Visa.

  • We accept Visa, Mastercard and cash only
  • We also accept AMEX, but please be aware there is a 5% charge added for any AMEX transactions.
  • NYC & Miami depots does not accept cash.
  • Full payment must be made before you can hit the road with your Campervan.

Cancellation Policy
The initial deposit paid is non-refundable. In addition to forfeiting your deposit, the following charges also apply:
- If the confirmed booking is cancelled at least 33 days before pick up / rental commencement, Escape will not impose any further charges.
- If the confirmed booking is cancelled within 17 - 32 Days of pick up, Escape will charge 15% of the total rental value as a cancellation fee.
- If the confirmed booking is cancelled within 11 - 16 Days of pick up, Escape will charge 25% of the total rental value as a cancellation fee.
- If the confirmed booking is cancelled within 10 days of pick up or there is a no-show, Escape will charge full balance.
All fees refer to full balance including sales tax.

Travel Insurance
We strongly recommend that clients ensure they take out the highest level of Travel Insurance. In many cases, this will cover any losses incurred if you are forced to cancel your booking

Booking amendments
It is possible to extend your rental, without incurring a fee, subject to availability.
It is possible to shorten your rental within 24 days of pick-up. Shortening a rental will be quoted as a new rental and will be calculated at the retail rate with any current specials not applicable.

Rates Calculation
Rates are calculated as per night. Where a rental crosses into another season, the rate will split to allow for the new season rate.

Allocations
Escape has more than 300 individually painted designs. Clients may like to request either comic, nature, scenic or surreal when they book. Escape will do their best to match up client requests with their allocated campervan.

Camper Upgrades
Escape reserves the right to upgrade clients booking from a Ventura to a Mavericks model. There would be no additional cost for the upgraded vehicle.

Driver's License/Proof of Identification
All drivers must hold a valid driver's license for the entire rental period and have a credit or debit card.
Only drivers specified on the contract are allowed to drive Escape Campervans.
The lead Renters name should match the credit or debit card held on file. It is recommended that Renters have an International drivers license.

Remember your driver’s license. All license options (detailed below) also require your original driver’s license from home.

  • We accept any current (and full) English-language license. UK, USA, Australia, EU etc. are all OK.
  • We also accept international driver licenses, provided they are accompanied with your valid home license
  • To hire a Escape Campervan, you need to be at least 21 years of age with a full drivers license.
  • We DO NOT accept a learner or restricted license.

The lead Renters name should match the credit or debit card held on file. It is recommended that Renters have an International drivers license.

Driving in the USA
Driving in the USA is a bit different and will probably be a little unfamiliar to you. We drive on the right for a start and within a couple of hours you can go from inner-city traffic, to highways, open roads and unsealed surfaces. 

So you will need to adapt and you MUST drive to the conditions. If it’s raining, slow down. If you’re on an unsealed road, PLEASE slow down. Take care and take your time exploring this wonderful country of ours.
We do expect 
a level of competency when it comes to driving a Campervan. Be cautious, be considerate of others. If driving makes you nervous, if you’re inexperienced, if you don’t know how to change a tyre or how to top up the oil, you need to ask yourself if a self-drive holiday is right for you?


However, if you’re an experienced, considerate and safe driver - that’s great. But there are a couple of things you still need to do to better prepare yourself for a safer road trip:

INSURANCE:

Campervan and Liability Insurance
There are two things to consider when renting a Campervan in America:

Damage to the Escape Campervan.
Damage to a third party.

1) Damage to the Escape Campervan
Campervan Insurance is not included in the cost of the rental. The hirer is responsible for any damage caused to the Escape Campervan.

For clients peace of mind, supplier does offer:

Collision Damage Waiver (CDW)
This costs only $10/Day and reduces the Campervan liability (or excess) to $0
CDW includes:
- Cover for accidental damages
- Windscreen (1 windscreen covered per rental)
- Protection against theft and vandalism
- Tire damage (2 tires covered per rental)

All customers are liable for ALL damage to the vehicle, including theft, if customers do NOT elect the CDW insurance ($10/day).

2) Damage to a third party
Basic Statutory limits for liability and property damage is included in Escape Campervans daily rate. The liability levels change between the various States as per below:

Your rental agreement provides you with basic statutory limits for liability and property damage. Escape Campervans covers the below levels for you.
The table that follows displays the minimum financial responsibility or compulsory liability insurance limits for all the states, District of Columbia, Puerto Rico, and the Canadian provinces.

The laws of all states express the requirements in terms of split limits.
For example, if the chart shows "25/50/10", the law requires that the policy provide at least $25,000 for bodily injury to each person, $50,000 for all bodily injury, and $10,000 for property damage, each accident.

The insurance laws of some states also state the requirement in terms of a combined single limit. For example, if the chart shows "15/30/10 or 40", the law provides that a policy with a combined single limit of at least $40,000 will also satisfy the requirement. A combined single limit of $40,000 means that the insurance will pay up to $40,000 for all bodily injury and property damage arising out of each accident. The required limits for the Canadian provinces are expressed as combined single limits only.

SUPPLEMENTARY LIABILITY INSURANCE (SLI)
If your own travel insurance does not include liability cover to US$1,000,000, the supplier can offer this for an additional $12.25/day. This is to protect your clients against 3rd party claims if they injure a person or damage someone else property.

SLI is excess automobile insurance that protects you and any authorized driver, as defined in the rental agreement, against third party automobile claims for bodily injury and property damage caused during permitted use of the rental vehicle.

SLI provides you with the following benefits:
* SLI provides you with a high limit of liability protection up to one million dollars ($1,000,000).
* When you accept SLI, the plan will provide you with excess coverage for the difference between that provided in your rental agreement, if any, and up to one million dollars ($1,000,000).

SLI does not provide coverage:
* If you violate the terms and conditions or use restrictions of the rental agreement.
* For bodily injury or property damage sustained by you and/or relatives, as defined, residing with you or by any authorized driver and/or relatives, as defined, residing with them
* For uninsured motorist, underinsured motorist, first party benefits, no-fault or other liability insurance that is optional or can be waived or rejected. When accepting SLI, you agree to waive or reject, to the extent allowed by law, any such insurance.
* SLI does not provide coverage for minimum financial responsibility limits if not provided for in your rental agreement.

U.S. and CANADIAN Residents:
If you are a U.S. or Canadian resident with a valid driver's license from either country and have automobile insurance that provides full coverage for rental vehicles (including minivans), you may have coverage for our Campervans. You should check with their insurance company prior to pickup of rental vehicle. You will need to decline our CDW and SLI options and you will be responsible for making a claim through your insurance company. You should supply us with your insurance information at the time of Campervan collection. All USA or Canadian residents MUST also bring proof of address. A recent utility bill will suffice. If proof of address is not shown, Escape will complete a credit check before departure.

Regardless of which Insurance option is selected, you will need to provide a valid Credit or Debit Card to allow Escape Campervans to Imprint before your depart. This is an imprint only. Funds are not collected or frozen and the purpose of the imprint is in the situation where damage occurs and the terms of the Rental Contract have been breached.

SUPPLEMENT TO RENTAL AGREEMENT
YOU and WE agree to Amend the Agreement entered into between YOU and US, on the same date as identified on the Rental Agreement as follows:

LIABILITY PROTECTION
A. We will indemnify, hold harmless, and defend You and any Authorized Operators from and against liability to third parties, which by definition excludes any of your or any authorized operators family members related by blood, marriage or adoption residing with you or them, for the difference between the liability protection limits provided in Paragraph "B" below and:

1) A MAXIMUM COMBINED SINGLE LIMIT OF ONE MILLION ($1,000,000) DOLLARS PER OCCURRENCE FOR BODILY INJURY AND PROPERTY DAMAGE, INCLUDING OWNERS LIABILITY IF THE ACCIDENT RESULTS FROM THE USE OF THE RENTAL VEHICLE AS PERMITTED BY THIS AGREEMENT.
2) THIS DOES NOT INCLUDE "UNINSURED MOTORIST", "UNDERINSURED MOTORIST", "SUPPLEMENTARY NO FAULT", OR ANY OTHER OPTIONAL COVERAGE TO THE EXTENT PERMITTED BY LAW; WE AND YOU HEREBY REJECT THE INCLUSION OF ANY SUCH COVERAGE. In the event that such coverage is imposed by law, the limits of such coverage will be the minimum required by law of the jurisdiction in which the accident occurs.

B. IF AN ACCIDENT RESULTS FROM THE USE OF THE RENTAL VEHICLE, YOUR INSURANCE OR THE INSURANCE OF THE OPERATOR OF THE RENTAL VEHICLE WILL BE PRIMARY. This means that we will not grant any defense or indemnity protection under this paragraph if either you or the operator of the Rental Vehicle are covered by any other valid and collectible automobile liability insurance, either primary, excess or contingent, with the limits at least equal to the minimum required by the state financial responsibility law where the accident occurs. Further, you warrant that such insurance coverage is effective as of the date of Rental Agreement or Addendum.

C. We warrant that the protection described in Paragraph "A" above is primary with respect to any insurance coverage you or any Authorized Operator may have other than as agreed to by parties in Paragraph "B" above. THIS PROTECTION IS VOID IN MEXICO. THE RENTAL VEHICLE MAY NOT BE DRIVEN INTO MEXICO WITHOUT FIRST OBTAINING SPECIFIC WRITTEN PERMISSION FROM US AND OBTAINING INSURANCE VALID IN MEXICO, WHICH IS AVAILABLE AT THE BORDER.

D. You and all Authorized Operators will indemnify and hold us, our agents and employees harmless from and against any loss, Liability and expense, in excess of the limits or beyond the scope of the protection provided for above, arising from the use or possession of the Rental Vehicle by You or by any Authorized Operator or other person with your, his or her permission.

E. Coverage is void and not effective if you violate the terms and or conditions of the Rental Agreement or if Rental Vehicle was obtained through a Rental Agreement based on Fraudulent information.

F. Renter accepts or declines Coverage at rate included in this web site and in the material provided to you. Acceptance is proof of Coverage under Policy issued to Lessor as outlined in this brochure. The SLI insurance program is offered by an independent insurance company. The insurance premium administration and/or service fee, if any, are included in the daily renal rate as stated in your these forms. The terms and conditions of SLI Coverage are outlined on this web site.

Insurance-Exclusions
The renter is fully liable for any damage to the Escape Campers campervan or third party property if:

  • The terms of the rental contract are breached.
  • The driver does not hold an appropriate driver’s licence.
  • Damage to the campervan is caused by wilful or reckless driving.
  • Driving under the influence of alcohol or drugs.
  • Driving on unsealed or restricted roads or restricted areas.
  • Water submersion or saltwater damage is caused through own fault.

Hirer’s obligations and ‘Operator error’
The hirer must maintain the water, oil and tire pressures during their journey.
Hirers will be fully accountable for, but not limited to the following:
Engine overheating, running out of oil, incorrect fuel put into vehicle, getting the vehicle stuck.
Liability is total damage and expenses despite the liability amount listed on the rental agreement. (CDW relates to accident damage only)

Mechanical Repairs and Accidents
Client should contact Escape on their 24 hour free phone number if you have any problems or any irregularities develop with the camper. Failure to notify Escape immediately of any performance irregularities, or damage, could affect grounds for compensation.

In the event of a breakdown Escape will either:

  • Provide a replacement vehicle
  • Refund the lost days use of the vehicle
  • Extend the hire to account for lost days

Client will not undertake any repairs without first contacting Escape.
There will be no refund for days lost, towing and any other expenses arising from ‘operator error’. Clients acknowledge that Escape Campervans Inc will not be liable for retrospective claims due to vehicle malfunction or accident damage.

Minimum Age of Drivers
All drivers must be 21 years of age or older. Proof of age must be ascertained by a valid driver's license. There is no maximum age limit.

Right to refuse a Client
If Escape Campervans Inc feel uncomfortable supplying a vehicle to a Renter who does not display adequate driving skills or road code knowledge, or supplier feel they may impose a risk to others or vehicles, supplier will cancel the rental. Escape will refund any unused days, but not including the deposit amount.

Additional Drivers
There is no additional charge for extra drivers.

Depot operating days
We operate 7 days a week and only close on the following days:

Christmas Day - December 25
New Years Day - January 1st
Independence Day - July 4th
Memorial Day - Last Monday in May (29 May)
Labor Day: 1st Monday in September (04 September)
Thanksgiving Day - 4th Thursday in November

Vehicle Pick Up and Drop Off

Campervan Collection:

  • Generally pick ups times are between 1pm-4pm if not otherwise indicated
  • It generally takes us 45 minutes to brief the driver and process paperwork for our Campervan hires, so please allow time for this. 
  • If you have listed a pick-up time in your online booking, please note this is indicative only. 
  • If you are collecting your Campervan on the same day as you fly in and your flight times are near our closing time, please advise us of these by email prior to your pick up date. 


Campervan Drop- Off:
Drop off time is between 8am-10am if not otherwise indicated.

Late returns of more than 1 hour will incur a full-day rental charge and possible other charges if their late return affects the next reservation.
Late afternoon returns can be arranged, but will incur an additional day charge. Clients can book an afternoon return, but they will be charged for the drop off day. No refunds will be granted for shortened rentals. There are no refunds for late pick up or early return of vehicles.

Important Reminders:

  • Please re-check your flight times and make sure that you can get to us within the time frames listed above.
  • Make allowances for possible flight delays.
  • You need to allow sufficient Airport processing and travel time from the airport to the Escape depot (remember that we do NOT provide an airport transfer service).
  • If it appears unlikely you will be able to meet the pickup deadlines outlined above, consider a pre-hire stay in a local hotel before collecting your vehicle and advise us accordingly. This is also a safer option after a long flight, as it allows you to rest before commencing your journey.

Late returns of more than 1 hour will incur a full-day rental charge and possible other charges relating to compensating follow on clients. Clients can book an afternoon return, but they will be charged for the drop off day.
No refunds will be granted for shortened rentals. There are no refunds for late pick-up or early return of vehicles.

Minimum and Maximum Rental Period
The minimum rental period is 7, 10 or 14 days depending on the route. There is no maximum rental period.

Mileage and options
Escape include 100 free miles for every day rented. This is averaged over the rental. eg. A 30-day booking will allow 3000 free miles.
Extra miles are charged at 0.25c/mile

100 miles per day $0.00
Extra 100 miles per day (200 miles per day total) $15/ day
Unlimited miles $25/ day
Extra miles purchased must be calculated for everyday of rental


State Sales Tax
Sales tax is added to the total hire amount and the sales tax rate applies to the City/depot of collection.
Los Angeles: 9.25%
Seattle: 17.7% (10.3% for rentals 30+ days)
San Francisco: 8.5%
Las Vegas: 8.15%
New York: 7%
Miami: 7%

Government Rental Surcharge fees
This is a tax imposed on rental vehicle agencies in certain locations. Escape pay this directly to the Government.
Miami: $2/day (Maximum charge $60)
New Jersey: $5/day (Maximum charge $140)

Burning Man Grooming Fee

  • Customer is charged a $750.00 grooming fee only if they are attending the festival and is valid for pickups at all locations.
  • If the customer says they didn’t attend, but go, they will get charged $1500.
  • Fee is to be paid upon arrival.

One way / drop off fees

One way fees will not be charged for same pick up and drop off depots. One way fees are the same for the reverse of the above pick up and drop off locations.
Key: LA (Los Angeles), SF (San Francisco), LV (Las Vegas), MIA (Miami), NY (New York), DEN (Denver), SEA (Seattle). 

Road Restrictions:
Renter is liable for all damages to vehicle, tires, towing charges and other expenses as a result of a breakdown, collision, or other, associated with operating Escape Campervans vehicles in these areas. Escape Campervans' insurance protection will also be null and void. The following are restricted areas:

  • Anywhere in Mexico.
  • Any unimproved road, trail, track
  • Any off-road areas (dunes, beaches, riverbeds, logging roads, forest trails, dirt trails etc.)
  • Any Salt plains including Burning Man festival (Unless prior consent has been granted and the grooming fee has been paid)
  • Death Valley between the dates 1st May and 30th September is one of the Worlds hottest places and not safe to operate a vehicle. If clients choose to travel through Death Valley in this period, they should be aware that they will be liable for any onroad assistance costs and repair to the Campervan. Insurance will be void.

General Rules

  • Escape Campervans are a no smoking zone.
    No pets are allowed in the vehicles during the summer months of 15 June - 15 September (except designated service dogs). Pets are allowed the rest of the year with an additional cleaning fee of $150.
  • All passengers must use seatbelts while the vehicle is in motion.
  • Escape Campervans does not accept any liability for any injuries incurred to passengers travelling in the back of the vehicle and/or while not using seatbelts.
  • Escape Rentals reserve the right to charge up to $1100 for any clients who have not previously disclosed to Escape that they will go to Burning Man.


General Conditions
All rentals are subject to the terms and conditions of Escape Campervans' Rental Agreement.

Rates, policies, terms and conditions are subject to change without notice. Escape Campervans assumes no responsibility for any detention, delay, loss, damage or injury that Renter might experience, no matter how it is caused or by whom.

Terms of booking on this website 

Information disclaimer
The rates on this website are often heavily discounted. This is due to our negotiated rates and bulk buying power. On very rare occasions, a rate may be displayed incorrectly due to our, or a vehicle supplier's error. In such a case, if you book with us at a quoted rate that is incorrect, we will notify you of any price change and give you the option to proceed or cancel. We make every effort to keep information on our site up to date, but we cannot guarantee this website is free of errors or omissions and retain the right to update or change the information published at any time.

Liability
To the extent permitted by law we/the owners of this website will not be liable to you or to any third party (whether in contract, tort, or otherwise) for any direct, indirect or consequential loss or damage (including but not limited to any accident, injury, delay or loss of enjoyment) arising out of your reliance upon information contained on this website, including but not limited to your use (or inability to use) any products or services described or procured through this website.

When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. If you encounter issues with the vehicle whilst on hire, you MUST report these issues directly to the relevant supplier at the earliest possible time. This will allow the supplier to remedy any issues and minimise any inconvenience to you.  If you fail to report any vehicle issues during your rental, it is likely that compensation will not be offered. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.95% credit card or debit card surcharge will be added when your payment is processed.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.

Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Motorhome rental alterations (all charges stated in local currency): 25.00
The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.

Refund Policy
We are committed to providing a quality service and aim for complete customer satisfaction. In the event of cancellation, any refunds or penalties are detailed in the terms and conditions of your selected vehicle that you are asked to read and accept at time of booking. In the event you are unsatisfied with our service, please contact us within 48 hours of placing your booking or request and we will work to resolve any issues and determine if compensation is due. In the event you have completed your rental and are unhappy with your vehicle, we are happy to assist you in seeking compensation from the operator of the vehicle.

Campervan and Liability Insurance
There are 2 things to consider when renting a Campervan in America:

Damage to the Escape Campervan.
Damage to a third party.

1) Damage to the Escape Campervan
Campervan Insurance is not included in the cost of the rental. The hirer is responsible for any damage caused to the Escape Campervan.

For clients peace of mind, supplier does offer:

Collision Damage Waiver (CDW)
This costs only $10/Day and reduces the Campervan liability (or excess) to $0
CDW includes:
- Cover for accidental damages
- Windscreen (1 windscreen covered per rental)
- Protection against theft and vandalism
- Tire damage (2 tires covered per rental)

All customers are liable for ALL damage to the vehicle, including theft, if customers do NOT elect the CDW insurance ($10/day).

2) Damage to a third party
Basic Statutory limits for liability and property damage is included in Escape Campervans daily rate. The liability levels change between the various States as per below:

Your rental agreement provides you with basic statutory limits for liability and property damage. Escape Campervans covers the below levels for you.
The table that follows displays the minimum financial responsibility or compulsory liability insurance limits for all the states, District of Columbia, Puerto Rico, and the Canadian provinces.

The laws of all states express the requirements in terms of split limits.  
For example, if the chart shows "25/50/10", the law requires that the policy provide at least $25,000 for bodily injury to each person, $50,000 for all bodily injury, and $10,000 for property damage, each accident.

The insurance laws of some states also state the requirement in terms of a combined single limit.  For example, if the chart shows "15/30/10 or 40", the law provides that a policy with a combined single limit of at least $40,000 will also satisfy the requirement.  A combined single limit of $40,000 means that the insurance will pay up to $40,000 for all bodily injury and property damage arising out of each accident.  The required limits for the Canadian provinces are expressed as combined single limits only.

SUPPLEMENTARY LIABILITY INSURANCE (SLI)

If your own travel insurance does not include liability cover to US$1,000,000, the supplier can offer this to you for an additional $9.95/day. This is to protect you against third party claims if you injure a person or damage someone else's property.

SLI is excess automobile insurance that protects you and any authorized driver, as defined in the rental agreement, against third party automobile claims for bodily injury and property damage caused during permitted use of the rental vehicle.

SLI Provides you with the following benefits:
* SLI provides you with a high limit of liability protection up to one million dollars ($1,000,000).
* When you accept SLI, the plan will provide you with excess coverage for the difference between that provided in your rental agreement, if any, and up to one million dollars ($1,000,000).

SLI does not provide coverage:
* If you violate the terms and conditions or use restrictions of the rental agreement.
* For bodily injury or property damage sustained by you and/or relatives, as defined, residing with you or by any authorized driver and/or relatives, as defined, residing with them
* For uninsured motorist, underinsured motorist, first party benefits, no-fault or other liability insurance that is optional or can be waived or rejected. When accepting SLI, you agree to waive or reject, to the extent allowed by law, any such insurance.
* SLI does not provide coverage for minimum financial responsibility limits if not provided for in your rental agreement.

U.S. and CANADIAN Residents:
If you are a U.S. or Canadian resident with a valid driver's license from either country and have automobile insurance that provides full coverage for rental vehicles (including minivans), you may have coverage for our Campervans. You should check with their insurance company prior to pickup of rental vehicle. You will need to decline our CDW and SLI options and you will be responsible for making a claim through your insurance company. You should supply us with your insurance information at the time of Campervan collection. All USA or Canadian residents MUST also bring proof of address. A recent utility bill will suffice. If proof of address is not shown, Escape will complete a credit check before departure.

Regardless of which Insurance option is selected, you will need to provide a valid Credit or Debit Card to allow Escape Campervans to Imprint before your depart. This is an imprint only. Funds are not collected or frozen and the purpose of the imprint is in the situation where damage occurs and the terms of the Rental Contract have been breached.

Insurance-Exclusions

The renter is fully liable for any damage to the Escape Campers campervan or third party property if:

  • The terms of the rental contract are breached.
  • The driver does not hold an appropriate driver’s licence.
  • Damage to the campervan is caused by wilful or reckless driving.
  • Driving under the influence of alcohol or drugs.
  • Driving on unsealed or restricted roads or restricted areas.
  • Water submersion or saltwater damage is caused through own fault.

Hirer’s obligations and ‘Operator error’
The hirer must maintain the water, oil and tire pressures during their journey.
Hirers will be fully accountable for, but not limited to the following:
Engine overheating, running out of oil, incorrect fuel put into vehicle, getting the vehicle stuck.
Liability is total damage and expenses despite the liability amount listed on the rental agreement. (CDW relates to accident damage only)

SUPPLEMENT TO RENTAL AGREEMENT
YOU and WE agree to Amend the Agreement entered into between YOU and US, on the same date as identified on the Rental Agreement as follows:

LIABILITY PROTECTION
A. We will indemnify, hold harmless, and defend You and any Authorized Operators from and against liability to third parties, which by definition excludes any of your or any authorized operators family members related by blood, marriage or adoption residing with you or them, for the difference between the liability protection limits provided in Paragraph "B" below and:

1) A MAXIMUM COMBINED SINGLE LIMIT OF ONE MILLION ($1,000,000) DOLLARS PER OCCURRENCE FOR BODILY INJURY AND PROPERTY DAMAGE, INCLUDING OWNERS LIABILITY IF THE ACCIDENT RESULTS FROM THE USE OF THE RENTAL VEHICLE AS PERMITTED BY THIS AGREEMENT.
2) THIS DOES NOT INCLUDE "UNINSURED MOTORIST", "UNDERINSURED MOTORIST", "SUPPLEMENTARY NO FAULT", OR ANY OTHER OPTIONAL COVERAGE TO THE EXTENT PERMITTED BY LAW; WE AND YOU HEREBY REJECT THE INCLUSION OF ANY SUCH COVERAGE. In the event that such coverage is imposed by law, the limits of such coverage will be the minimum required by law of the jurisdiction in which the accident occurs.

B. IF AN ACCIDENT RESULTS FROM THE USE OF THE RENTAL VEHICLE, YOUR INSURANCE OR THE INSURANCE OF THE OPERATOR OF THE RENTAL VEHICLE WILL BE PRIMARY. This means that we will not grant any defense or indemnity protection under this paragraph if either you or the operator of the Rental Vehicle are covered by any other valid and collectible automobile liability insurance, either primary, excess or contingent, with the limits at least equal to the minimum required by the state financial responsibility law where the accident occurs. Further, you warrant that such insurance coverage is effective as of the date of Rental Agreement or Addendum.

C. We warrant that the protection described in Paragraph "A" above is primary with respect to any insurance coverage you or any Authorized Operator may have other than as agreed to by parties in Paragraph "B" above. THIS PROTECTION IS VOID IN MEXICO. THE RENTAL VEHICLE MAY NOT BE DRIVEN INTO MEXICO WITHOUT FIRST OBTAINING SPECIFIC WRITTEN PERMISSION FROM US AND OBTAINING INSURANCE VALID IN MEXICO, WHICH IS AVAILABLE AT THE BORDER.

D. You and all Authorized Operators will indemnify and hold us, our agents and employees harmless from and against any loss, Liability and expense, in excess of the limits or beyond the scope of the protection provided for above, arising from the use or possession of the Rental Vehicle by You or by any Authorized Operator or other person with your, his or her permission.

E. Coverage is void and not effective if you violate the terms and or conditions of the Rental Agreement or if Rental Vehicle was obtained through a Rental Agreement based on Fraudulent information.

F. Renter accepts or declines Coverage at rate included in this web site and in the material provided to you. Acceptance is proof of Coverage under Policy issued to Lessor as outlined in this brochure. The SLI insurance program is offered by an independent insurance company. The insurance premium administration and/or service fee, if any, are included in the daily renal rate as stated in your these forms. The terms and conditions of SLI Coverage are outlined on this web site.
